Appeals Process
(University Citations only)
All appeals must be submitted in writing within 14 days of issuance of the citation. Moving violations may not be appealed: violations #14 through #19.
If the owner/operator of the vehicle believes the citation is unwarranted, an appeal can be filed. If a request to appear in person before the Traffic Appeals Committee has been indicated on the appeal form, the appellant will be notified of the time and place of the committee meeting. If the appellant does not appear before the Traffic Appeals Committee within the first hour, the appeal will be evaluated solely on the information on the appeal form.
A visitor may request that the appropriate dean or university administrator responsible for the event or visit to file an appeal, on the visitor's behalf, with the University Traffic Appeals Committee. Should the administrator agree to file the appeal and lose, then the administrator is financially obligated to pay the appropriate fine. There is no further appeal process.
Once the committee makes a decision on the appeal, written notification will be sent to the appellant. If the committee does not decide in favor of the citation holder, the individual has 14 days to resolve the citation before the reinstatement fee doubles.
If the additional enforcement action to resolve a citation has occurred (encumbrance of student records), an appeal to the Traffic Appeals Committee cannot be made except on the recommendation of the chairperson of the Traffic Appeals Committee.
The UH-Clear Lake Traffic Appeals Committee is an administrative body appointed by the president with the authority to hear appeals of administrative traffic citations issued by the University Police. The function of the committee is to decide by a majority vote the merit of appeals presented to them as prescribed by the University Traffic and Parking Regulations and this document.
The Committee is composed of five members.
Each member represents a segment of the university community, two (2) students, preferably one undergraduate student and one graduate student, one (1) staff member, and two (2) faculty members serving as committee chair, and co-chair.
